Fmr. FedEx Worker Wins Faith Discrimination Case

A federal judge has ruled in favor of a former FedEx employee in a religious discrimination lawsuit.

Eric Weathers sued the shipping company after they banned him from discussing his faith and Bible-based degree at work.

Weathers said he was demoted and later resigned after a co-worker complained he was too open about his faith.

In his case, he cited 1 Peter 3:15, which instructs "always be prepared to give an answer for the hope that you have."

FedEx asked a summary judgment in January but the court denied the request.

U.S. District Judge Edmond E. Chang concluded there was sufficient evidence "for a reasonable jury to find that Weathers suffered the requisite significant negative alteration in the workplace" to constitute an "adverse employment action" as a result of FedEx's failure to accommodate his religion.

"Weathers' superiors told him he could not discuss religion, even if asked, and he was told that he must affirmatively misrepresent his college degree," wrote Judge Chang.

The Alliance Defense Fund, which represented Weathers in the case, was pleased with the judge's ruling.

"We hope this ruling will remind corporate America that it's simply bad business to force employees to check their faith at the door," ADF attorney Jason Craddock said.
