California's Prop 8 Likely Headed to Supreme Court
A federal appeals court refused Tuesday to reconsider an earlier ruling against California's effective ban on gay marriage, meaning the fight for Proposition 8 will likely head to the U.S. Supreme Court.In February, two of three judges from the 9th U.S. Circuit Court of Appeals ruled that Prop 8 "serves no purpose" other than to "lessen the status and human dignity of gays and lesbians in California" by banning same-sex marriage.
Supporters of the measure, which defines marriage as only being between one man and one woman, then petitioned to have a larger panel of judges review the ruling.
But Tuesday, the court refused. Now, lawyers from the Alliance Defense Fund representing Prop 8 say they are "absolutely" ready to fight for measure at the Supreme Court.
California voters approved Proposition 8 in 2008 and it has faced legal battles since.
Sponsors of Prop 8 expect the Supreme Court to decide this fall whether to hear the case.
